Terms & Conditions
These terms govern your use of the Tenurely website and your engagement with any of our organisational services. Please read them before making an enquiry or booking a session. By using this website or engaging our services, you agree to these terms.
1. Definitions
- "Tenurely", "we", "us", "our" — refers to the service provider operating from 3-1 Jalan PJU 8/5D, Damansara Perdana, 47820 Petaling Jaya, Selangor, Malaysia.
- "User", "you", "your" — refers to any individual who accesses this website or engages Tenurely for services.
- "Services" — refers to the organisational services offered by Tenurely, including the Working Life Timeline Session, Employer Records Reconstruction Support, and Household Archive Retainer.
- "Engagement" — refers to a specific contracted service arrangement between Tenurely and a client, confirmed in writing with a scope document.
- "Agreement" — refers to these Terms & Conditions together with any written scope document applicable to a specific engagement.
- "Templates" — refers to the printed and digital documents produced or provided by Tenurely during sessions, including timeline templates, letter formats, and tracking sheets.
2. Acceptance of These Terms
By accessing this website or proceeding with an enquiry, you confirm that you have read and agree to be bound by these terms. You must be at least 18 years of age and have the legal capacity to enter into a binding agreement.
If you are using our services on behalf of another person (such as an elderly parent), you represent that you have the authority to do so and that the person on whose behalf you are acting is also 18 or over.
3. Service Description and Scope
Tenurely provides organisational support for pension and retirement records. Our services are limited to the following categories of work: employment timeline construction, document gap identification, correspondence format preparation, and archive organisation and cataloguing.
Our services do not include, and are expressly not intended to provide: legal advice, financial planning, tax advice, medical assessment, pension calculation, interpretation of entitlements, representation before any authority or institution, or any communication made in the client's name.
Services are currently available to clients located in Malaysia. Sessions are conducted in English from our office in Petaling Jaya, Selangor. Remote arrangements may be available subject to written agreement.
4. Your Responsibilities
When using our website or engaging our services, you agree to:
- Provide accurate and complete information during enquiries and sessions
- Attend scheduled appointments or provide at least 48 hours' notice of cancellation
- Review, sign, and send all correspondence yourself — Tenurely does not communicate on your behalf
- Use templates and documents provided by Tenurely only for the purpose for which they are provided
- Not use this website for any unlawful purpose or in any manner that could damage or impair access to or use of it
- Not misrepresent your identity or your relationship to a third party whose records you are organising
5. Intellectual Property
All website content, service descriptions, and session templates created by Tenurely remain the intellectual property of Tenurely. You are granted a personal, non-exclusive, non-transferable licence to use the templates provided to you during an engagement for your own personal records management purposes only.
You may not reproduce, distribute, or commercially exploit any templates or materials produced by Tenurely without prior written consent.
6. Fees and Payment
All fees are stated in Malaysian Ringgit (MYR) and are confirmed in writing at the start of each engagement. Current fees as of the effective date of these terms are:
- Working Life Timeline Session: RM 505 per session
- Employer Records Reconstruction Support: RM 2,240 for the six-week engagement
- Household Archive Retainer: RM 4,060 for the six-month period
Payment terms will be confirmed in the engagement scope document. Fees are payable in accordance with the schedule agreed at the start of the engagement. Tenurely reserves the right to revise fees for future engagements; existing engagements will not be subject to mid-engagement fee increases.
Cancellations and Refunds
For session cancellations made more than 48 hours in advance, no fee applies. Cancellations made within 48 hours of a scheduled session may be subject to a partial session fee. For multi-session engagements, fees paid for completed milestones are non-refundable. If Tenurely cancels a session, it will be rescheduled at no additional charge. Refund requests outside these terms will be considered at Tenurely's discretion.
7. Service-Specific Terms
Working Life Timeline Session
Sessions are two hours in duration. One family member may attend at no additional cost. The completed timeline and supporting materials are provided to the client at the end of the session and remain the client's property. Tenurely retains no copy of completed client timelines.
Employer Records Reconstruction Support
This is a six-week engagement. The client is responsible for sending all correspondence. Tenurely prepares formats and maintains the tracking log but does not write or send letters in the client's name under any circumstances. The written close summary provided at the end of the engagement describes the status of the records process as of the closing date; it is not a professional opinion on entitlements or outcomes.
Household Archive Retainer
This is a six-month retainer. Tenurely will maintain the master register and correspondence log throughout the period. The bound chronology and digital mirror are produced at the close of the retainer and handed over to the client. Tenurely retains no digital copy of the archive after handover. The directory of registered professionals provided at handover is compiled for reference only; Tenurely makes no recommendation regarding any professional listed.
8. Disclaimers
Tenurely's services are organisational in nature. We make no statement about, and accept no responsibility for, any legal entitlements, financial outcomes, or administrative decisions that may follow from the use of records organised or documents prepared during an engagement.
This website and its content are provided for general informational purposes. Nothing on this website constitutes legal, financial, or professional advice of any kind.
Tenurely does not warrant that records located or correspondence sent during an engagement will produce any particular response from employers, government bodies, or institutions.
9. Limitation of Liability
To the extent permitted by Malaysian law, Tenurely's total liability arising from or in connection with any engagement shall not exceed the total fees paid by the client for that engagement.
Tenurely is not liable for any indirect, consequential, or special loss arising from the use of our services or this website, including loss arising from the failure of third parties (employers, government bodies) to respond to correspondence.
Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Malaysian law.
10. Indemnification
You agree to indemnify and hold harmless Tenurely, its staff, and its coordinators from any claims, losses, or expenses (including reasonable legal costs) arising from your breach of these terms, your misuse of services or templates, or any false or inaccurate information you provide during an engagement.
11. Termination
Either party may terminate a multi-session engagement by giving written notice. Where a client terminates mid-engagement, fees for completed milestones and materials already prepared remain payable. Where Tenurely terminates an engagement due to a client's breach of these terms, no refund of fees paid will be issued for completed work.
Clauses relating to intellectual property, disclaimers, limitation of liability, and dispute resolution survive termination of any engagement.
12. Dispute Resolution and Governing Law
These terms are governed by the laws of Malaysia. In the event of a dispute, the parties agree first to attempt resolution through direct discussion. If direct discussion does not resolve the matter within thirty days, either party may refer the dispute to mediation through the Malaysian Mediation Centre (MMC) before commencing any legal proceedings.
Any legal proceedings arising from these terms or an engagement shall be subject to the exclusive jurisdiction of the courts of Malaysia.
13. General Provisions
- Entire Agreement: These terms, together with the engagement scope document, constitute the entire agreement between you and Tenurely for the relevant service.
- Severability: If any provision of these terms is found to be unenforceable, the remaining provisions remain in full force.
- Waiver: Failure to enforce any right under these terms does not constitute a waiver of that right.
- Assignment: You may not assign or transfer your rights or obligations under these terms without prior written consent from Tenurely.
- Notices: Formal notices under these terms should be sent in writing to the address below or to [email protected].
14. Changes to These Terms
We may update these terms from time to time. When we do, the effective date at the top of this page will be revised. Continued use of this website or continued engagement with our services after any update constitutes acceptance of the revised terms. For clients in active engagements at the time of a material update, we will communicate changes directly.
